Article 1 - Scope

These conditions of sale concern products sold on the site belonging to SAS MAGNUM DE VIN or by telephone and are applicable to the exclusion of all others, in particular those governing in-store sales.

Article 2 – Acceptance

The acceptance by the customer of these conditions is materialized by his electronic signature concretized by the validation click, as well as by the communication of his bank details for the purpose of payment of his order.

This electronic signature has the value of a handwritten signature between the parties. This dual approach is equivalent for the customer to acknowledge that he has fully read and that he unreservedly approves all of these conditions.

Article 3 - Orders

Orders are placed on the website. The contractual information, written in French, will appear on the order confirmation document.

The validation of your order implies full acceptance of these conditions of sale.

The sale will only be concluded from the confirmation of the order by SAS MAGNUM DE VIN. reserves the right to refuse an order from a customer with whom there is a dispute concerning a previous order.

Under Article L221-5 of the Consumer Code, the customer has a period of 14 clear days to exercise his right of withdrawal without having to provide justification or suffer penalties. The customer is then reimbursed (with the exception of the costs of returning the product, which remain at his expense). The conditions are defined in Article 14 of these general conditions of sale.

Bottles of any size must be returned in their original packaging intact, accompanied by any accessories, or documentation. The label, the capsule must be in perfect condition. Finally, they must not have been uncorked or consumed totally or partially.

The return costs are the responsibility of the customer. The refund will be made after recovery of the goods, subject to their good condition, within 10 days of receipt of the returned products.

Article 4 - Products

The presentation photographs illustrating the products offered in the electronic catalog of our site tend to describe and present the articles with the greatest accuracy. However, a winemaker, producer or merchant may have to slightly modify the presentation label, especially for a new vintage.

Therefore, these photographs cannot be considered as entering the contractual field and variations in the representation of the items can neither engage the responsibility of SAS MAGNUM DE VIN nor affect the validity of the sale.

Article 5 - Availability

SAS MAGNUM DE VIN cannot guarantee the availability of the entire catalogue presented online. Our product offers and prices are valid as long as they are on the site, within the limits of available stocks. Information on the availability of the products is provided to the customer at the time of placing his order, subject to error.

For certain references the site reserves the right to limit the quantity ordered per customer, per order or per delivery point.

In the event of unavailability after placing his order, we will inform the customer by email, your order will be immediately canceled and refunded if necessary.

In any case, no compensation can be paid.

Pre-order wine purchases, en primeur or future vintages that are offered on our site will be shipped as soon as they are available. SAS MAGNUM DE VIN cannot be held responsible for any delay in the date of marketing by the winegrowers.

Article 6 - Price

Our prices are indicated in euros, all taxes included, including VAT for the France (excluding preparation and shipping costs which are dependent on the shipping area and calculated before confirmation of the order).

Prices may be updated at any time without notice, but items are invoiced based on the current price, displayed at the order confirmation .

Article 7 - Shipping costs

Shipping costs are calculated as accurately as possible according to your delivery address, the total weight/volume of your order and the number of bottles. You can get an estimate by making a basket with the items you are interested in.

Article 8 - Delivery

After confirmation of the order, SAS MAGNUM DE VIN undertakes to deliver to its carrier within 12 to 48 hours, all references ordered by the buyer. (with the exception of pre-orders, en primeur wines or future vintages).
For deliveries in Metropolitan France, the products ordered are delivered, at the customer's choice, to the address or relay point designated by him when ordering.

Magnum de vin offers home delivery against signature in 24 to 48 hours from Monday to Friday (excluding public holidays), with the carrier DPD. The price of delivery on Magnum wine is fixed at a flat rate of € 9.00. Delivery is free from 250,00€ of purchase on our website. Shipping costs include the costs of packaging and shipping items. The general order processing time is 24 hours. All orders placed before 12:00 from Monday to Friday will be shipped during the day. Orders placed after 12:00 or on Saturdays and Sundays will be processed the next day or Monday for orders placed on weekends.

All products are carefully packed in our premises and handed over to our carrier. You are informed by email of the processing of your order, and receive the tracking code of your package as soon as it is handed over to DPD.

In order to offer you the best delivery service, Magnum de vin has chosen to opt for fast and secure delivery from the DPD carrier. The advantages of DPD:

  • Secure and fast shipping
  • Reschedule the delivery to the address of your choice in case of absence
  • Track your package

The products can only be delivered to the delivery address indicated by the customer during the ordering process. The information provided by the customer, when placing the order, binds him: in case of error in the wording of the recipient's details, the seller can not be held responsible for the impossibility in which it could be to deliver the product.

In case of delay in shipment, you will be notified by email. In this case, and as long as the product is not shipped, you can cancel your order.

Orders not served within 30 days will be cancelled unless otherwise stated.

The customer must notify the carrier and SAS MAGNUM DE VIN of any reservation on the product delivered (damaged package, already opened.) within 24 hours of receipt of the product.

In case of apparent defects, the customer has the right of return under the conditions provided for in this document.

Article 9 – Protection of minors

The provisions of the Public Health Code on the sale of alcohol to minors were amended in article 93 of the HPST Act. The sale of alcohol is prohibited to persons under 18 years of age

When registering, the customer must acknowledge his majority. In addition, with each order, during validation and before payment, the customer by accepting these general conditions of sale will again recognize his majority.

Article 10 – Force majeure

Are considered as cases of force majeure relieving the seller of his obligation to deliver : war, riot, fire, strikes, accidents, pandemic and the impossibility of being supplied.

Article 11 – Payment

Orders are invoiced and payable in euros.

The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by email.

Payment is made by credit card (Visa, Eurocard, Mastercard), PayPal, bank transfer or check. In case of payment by bank transfer, the company reserves the right to cancel the order if the transfer has not been received within 72 hours. In case of payment by check, the company Magnum de vin SAS reserves the right to cancel the order in the absence of receipt of the check within 5 working days.

With regard to payments by bank transfer or check, delivery occurs upon receipt.

Article 12 - Securing payments

Payment by credit card on the site is fully secured and encrypted by our bank. Sensitive information transmitted at the time of payment is SSL encrypted.

Article 14 – Right of withdrawal

14.1 Right of withdrawal and terms of return.

You have a right of withdrawal of thirty 14 calendar days from the date of invoice. During this period, you may return the products without having to justify reasons or pay a penalty; the return costs remaining at your expense.
To exercise your right of withdrawal, you can use the standard withdrawal form to be completed here, or make any declaration indicating your intention to return the product to us.
Returns must concern new items (unused product) accompanied by all their possible accessories, instructions for use and documentation.
Items returned incomplete, damaged, damaged or soiled will not be taken back.

14.2 Refund.

SAS MAGNUM DE VIN undertakes to refund the returned products, subject to compliance with the conditions mentioned above.
The refund will be made within 10 days via the means of payment used during the returned order.

Article 15 - Legal guarantee of conformity

SAS MAGNUM DE VIN is liable for defects of conformity of the goods with the contract under the conditions of Article L. 211-4 et seq. of the Consumer Code and hidden defects of the thing sold under the conditions provided for in Articles 1641 and following of the Civil Code.

If you act as a legal guarantee of conformity, you:

  • have a period of two years from the delivery of the property to act;
  • may choose between repair or replacement of the good, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code;
  • are exempted from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following the delivery of the goods if it is new, or the six months following the delivery of the goods if it is second-hand.

This legal guarantee of conformity applies independently of any commercial guarantee granted.

You can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and, in this case, you can choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Article L217-4 of the Consumer Code
The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been charged to him by the contract or has been carried out under his responsibility.

Article L217-5 of the Consumer Code
The property is in conformity with the contract:
(1) If it is fit for the use usually expected of a similar property and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling;
2 ° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted.

Article L217-12 of the Consumer Code
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

Article L217-16 of the Consumer Code
When the buyer asks the seller, during the course of the commercial guarantee granted to him at the time of the acquisition or repair of movable property, for a restoration covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee that remained to run.
This period runs from the buyer's request for intervention or the making available for repair of the property in question, if this provision is subsequent to the request for intervention.

Article 1641 of the Civil Code
The seller is bound by the guarantee in respect of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have given a lower price, if he had known them.

Article 1648 of the Civil Code (first paragraph)
The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

Article 16 - Disputes

In case of dispute, French law applies.

In accordance with the provisions of Articles L 611-1 and R 612-1 et seq. of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, he may submit his complaint free of charge to the consumer mediator. The mediator must be seized within a maximum period of one year from the initial complaint.
